Inheritance shares calculator (Romania)

Find out who inherits and what share each heir takes when there is no will. The calculation follows the rules of intestate succession (moștenire legală) in Codul civil (the Civil Code): the classes of heirs, the surviving spouse's share and the per stirpes division for predeceased children. You can add the value of the estate to see the amounts in lei as well.

Legal basis: art. 964-983 Codul civil · Updated 20 October 2026

Is there a surviving spouse?

Their descendants inherit by representation, per stirpes (art. 966 and art. 968 Codul civil).

Living parents
Any living grandparents or great-grandparents?
Any living uncles, aunts or first cousins?

If you fill it in, the shares are also shown as amounts in lei.

Intestate shares

Shares under intestate succession

2 heirs at law

The reserved portion is half of the share the heir would take by law (art. 1.088 Codul civil).

The result assumes intestate succession, with no will, no renunciation and no unworthiness to inherit. Successive inheritances (an heir who died after the deceased, before the estate was settled) are not covered. The right to accept or renounce the inheritance must be exercised within one year of the opening of the succession (art. 1.103 Codul civil).

The result is indicative and is not legal advice: the facts of your case can change the calculation.

Every case has details a calculator cannot capture. I can tell you how the rules apply to your situation.

When a person dies without a will, the law decides who inherits and in what proportions. The rules are in Codul civil, art. 964-983, and apply in the same way before a notary or in court. The calculator above shows you the exact fractions for the family situation you describe, assuming that everyone called to inherit accepts the inheritance.

Who inherits, and in what order?

Art. 964 Codul civil groups the relatives of the deceased into four classes: class I, the descendants, that is the children and their own descendants; class II, the parents (privileged ascendants) together with the brothers, sisters and their descendants (privileged collaterals); class III, the grandparents and great-grandparents (ordinary ascendants); class IV, the ordinary collaterals up to the fourth degree, that is uncles, aunts, first cousins and the brothers or sisters of the grandparents. A closer class excludes the next one: as long as there is even one child, the parents and the brothers and sisters of the deceased receive nothing. Within a class, relatives of a closer degree exclude those of a more remote degree, and relatives of the same degree share equally.

The surviving spouse does not belong to any class: the spouse inherits alongside any of them (art. 971 Codul civil). The spouse's share is deducted first, and the rest is divided between the relatives in the class called to inherit.

What share does the surviving spouse take?

The spouse's share depends on the relatives the spouse inherits alongside, under art. 972 alin. (1) Codul civil:

The spouse inherits alongside The spouse's share
The deceased's descendants (class I) 1/4
Parents and brothers or sisters together (class II) 1/3
Only parents, or only brothers or sisters 1/2
Grandparents, great-grandparents, uncles, aunts or cousins (classes III-IV) 3/4
No relative in any of the four classes the whole estate

An example: with an estate of 400,000 lei, a spouse inheriting alongside two children takes 1/4, that is 100,000 lei, and each child takes 3/8, that is 150,000 lei. If the deceased had no children but had both parents and two brothers or sisters, the spouse takes 1/3, each parent 1/6 and each brother or sister 1/6 (art. 977 and art. 978 Codul civil).

How is the estate divided between children?

The children share their part equally: the whole estate when there is no surviving spouse, or 3/4 when they inherit alongside the spouse (art. 975 Codul civil). If a child died before the parent, that child's own children step into their place by representation and divide per stirpes exactly the share their parent would have taken (art. 966 and art. 968 Codul civil). For example, where the deceased leaves one living child and one predeceased child who left two children, the living child takes 1/2 and each grandchild 1/4, not 1/3 each.

Similar rules apply in class II: a single parent inheriting alongside brothers and sisters takes 1/4 and the brothers and sisters 3/4; two parents take 1/2 together (art. 978 Codul civil). Between siblings the split is equal, with one nuance for siblings from different marriages or relationships: their share is divided between the maternal and the paternal line (art. 981 Codul civil). The calculator covers the case where all the siblings are of the same type; mixed cases need a separate analysis.

What is the reserved portion?

Even when there is a will, the law protects certain heirs: the surviving spouse, the descendants and the parents of the deceased are forced heirs (moștenitori rezervatari), under art. 1.087 Codul civil. The reserved portion (rezervă succesorală) of each is half of the share they would have taken by law without the will or the gifts (art. 1.088 Codul civil). A child who would have taken 1/2 of the estate as an heir at law keeps at least 1/4, whatever the will says. This calculator shows only the intestate shares; working out the reserved portion and the disposable portion depends on the gifts made during the deceased's lifetime and needs a concrete review of the file.

The result assumes pure intestate succession: no will, no renunciation of the inheritance, no unworthiness to inherit (nedemnitate) and no successive inheritances. If your situation includes any of these, or if the heirs cannot agree on the division, write to me and I will look at your case. For the cost of a court partition of the estate, use the partition section of the stamp duty calculator.

Frequently asked questions

Who inherits in Romania if there is no will?
Under intestate succession, the estate passes to the relatives of the deceased and to the surviving spouse. Under art. 964 Codul civil, relatives inherit in four classes: class I, the descendants; class II, the parents (privileged ascendants) together with the brothers, sisters and their descendants (privileged collaterals); class III, the grandparents and great-grandparents (ordinary ascendants); class IV, the ordinary collaterals up to the fourth degree: uncles, aunts, first cousins and the brothers and sisters of the grandparents. A closer class excludes the next one, and the surviving spouse inherits alongside any of the classes (art. 971 Codul civil).
What share of the estate does the surviving spouse take?
Under art. 972 alin. (1) Codul civil, the surviving spouse takes 1/4 alongside the descendants, 1/3 alongside both the parents and the brothers or sisters of the deceased, 1/2 alongside only the parents or only the brothers or sisters, and 3/4 alongside the grandparents, great-grandparents, uncles, aunts or cousins. If there are no relatives in any of the four classes, the spouse takes the whole estate (art. 971 alin. (2) Codul civil).
What happens to the share of a child who died before the parent?
The children of the predeceased child step into their parent's place by representation (art. 965 Codul civil). Representation works only for the descendants of the deceased's children and for the descendants of brothers and sisters (art. 966 Codul civil), and the estate is divided per stirpes, by branch (art. 968 Codul civil): the share the predeceased child would have taken is split equally between that child's descendants, not per capita between all the grandchildren.
How is the estate divided between parents and siblings?
When they inherit together, art. 978 Codul civil divides the class II share by the number of parents: a single parent takes 1/4 and the brothers and sisters, however many, take 3/4; two parents take 1/2 together, and the other 1/2 goes to the brothers and sisters. When the surviving spouse also inherits, these fractions apply to what is left after the spouse's share of 1/3 (art. 977 Codul civil).
Do half-siblings inherit the same as full siblings?
Not always. When the siblings come from different lines, art. 981 alin. (3) Codul civil splits their share equally between the maternal and the paternal line: full siblings take in both lines, half-siblings on the father's side only in the paternal line, and half-siblings on the mother's side only in the maternal line. When all the siblings are of the same type, the split is equal (art. 981 alin. (1) Codul civil), and the calculator covers only this situation.
What is the reserved portion?
The reserved portion is the part of the estate that certain heirs are entitled to even against the wishes of the deceased, expressed in a will or through gifts (art. 1.086 Codul civil). The forced heirs are the surviving spouse, the descendants and the parents of the deceased (art. 1.087 Codul civil), and the reserved portion of each is half of the share they would have taken by law without gifts, legacies or disinheritance (art. 1.088 Codul civil).
