I am Denisa Lupașcu, a lawyer (avocat) in Cluj and a member of the Cluj Bar (Baroul Cluj) since 2023. I run my own office, which means the person you first speak to is the person who reads your documents, drafts your filings and stands up in court for you. I work in Romanian and English.
Where did I train?
I graduated from the Faculty of Law of Babeș-Bolyai University (Universitatea Babeș-Bolyai) in Cluj-Napoca. Law school gave me the method; the bar gave me the rules I work under. Everything you tell me stays between us, including when you write to me from another country and only ever meet me on a screen.
How do I work?
I start by listening. You describe the situation in your own words, I ask questions until I understand the facts and the dates, and only then do I tell you what the law says and what I think you should do. Sometimes the honest answer is that a court case is not worth it, and I will say so.
Consultations take place at my office, by phone or by video call. You can send documents in English. Anything that has to be filed with a Romanian court or authority is written in Romanian, and I prepare it myself, so you never have to sign something you do not understand.
There is a line from Marcus Aurelius that I keep coming back to: “Everything we hear is an opinion, not a fact. Everything we see is a perspective, not the truth.” In a dispute, both sides are sure they are right. My job is to find out what can actually be proven and build the case on that.
Which areas of law do I handle?
For clients from abroad, the questions usually fall into a few areas:
- Company formation: setting up and changing a limited liability company (SRL) at the Trade Register.
- Debt recovery: payment orders, small claims and enforcement through a bailiff.
- Real estate and rentals: lease agreements, deposits, eviction, buying property as a foreign national.
- Traffic fines and contraventions: challenging a fine notice before the first-instance court (Judecătoria).
- Employment law: dismissal, notice periods, unpaid wages, non-compete clauses, disputes before the Cluj Tribunal (Tribunalul Cluj).
- Dealing with Romanian authorities: requests, complaints and administrative appeals.
I also handle family, civil and criminal matters for Romanian-speaking clients; those pages are on the Romanian side of the site.
Where am I?
My office is at Calea Dorobanților 39-41 in Cluj-Napoca. I appear before the courts in Cluj and, when a case requires it, before courts elsewhere in Romania. If you would like to talk, the contact page explains what to send me first.
